Terms and Conditions
This website (www.delphi-philosophy.com) is owned and operated by David Whitney and Rosie Coulson. These Terms set out the terms and conditions under which you may use our website, products and services as offered by us. This website offers visitors educational resources and e-books. By accessing or using the website, you approve that you have read, understood, and agree to be bound by these Terms.
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these Terms periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms through notification via e-mail, social media and on the website. Your continued use of the website or our products after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the products.
In order to download our products or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to download our products and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
The website, products and all materials therein or transferred thereby, including, without limitation, text, images, graphics, logos, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of David Whitney and Rosie Coulson. Except as explicitly provided, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and by use of our site and products you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process. Products on our website consist of downloadable files, the links to which are e-mailed to the customer on completion of the sale. Links are valid for 30 days and can also be requested after this time by contacting us directly through the website. We accept no responsibility for difficulties in downloading or accessing these materials if there are issues out of our control, such as entering incorrect contact information at the point of sale, or technical issues with downloading and opening the purchased files.
Vouchers offered, such as when purchasing the full scheme of Delphi the Philosopher after first purchasing an enquiry, are supplied at our discretion and will be honored if the correct code is entered at check-out. Voucher codes are only to be used in connection to the e-mail address they are supplied to and should not be passed onto any third party. We are unable to apply vouchers after purchase.
The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. We also reserve the right to use, change or cancel promotions and vouchers at any time. We may, without prior notice, also change the products or stop providing access to any part of the website at any time.
Products downloaded are at the user’s own risk, and we cannot accept any responsibility for any harm caused by downloading and use of the files we provide, including if files have been modified by a third party without our knowledge.
Purchased products are provided for the exclusive use of the buyer and the institution to which they professionally belong, such as their school or educational establishment. Materials can be shared and used within the institution but sharing or copying of materials beyond this is deemed a breach of copyright and these Terms.
Due to the nature of the product being an instant download, once products have been purchased and the download link has been sent, refunds will not usually be possible except in exceptional circumstances. This will be at our discretion but will include technical issues for which we are responsible (such as corrupt or mistaken files). Purchases made in error, or an inability to download resources due to giving us mistaken contact information, require you to give us immediate notification of the error and may be refunded at our discretion.
Limitation of Liability
The customer is responsible for the use of the website, products and activities arising from using the materials. You agree to indemnify and hold David Whitney and Rosie Coulson harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the products offered.
To the maximum extent permitted by applicable law, in no event shall David Whitney and Rosie Coulson be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the website or products offered.
To the maximum extent permitted by applicable law, David Whitney and Rosie Coulson assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our products; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United Kingdom, without respect to its conflict of laws principles.
